1 Evaluative mediation is a process facilitated by a mediator to assess the relative strengths and weaknesses of each party’s position and to determine the likely results if the issue(s) between the parties were decided by a hearing.
2 Interest-based mediation is a process facilitated by a mediator to establish each party’s interests in the issue(s) and to develop a resolution that addresses, to the greatest degree possible, those interests so that the parties can commit to the resolution.
